ORDER

This application has been filed seeking payment out the amount deposited in Court consequent to Mediation process undertaken among the parties.

2. In the affidavit filed in support of the Judges Summons, it had been stated that there was a reference under Section 22 (3) of the Tamil Nadu National Highways Act, 2001 with respect to the land in 1/4

T.S.No.216/5 measuring 6614.478 sq.ft equallent to 614.5 sq.mtrs in Velacherry which had been acquired by the High Ways Department. A Total compensation amount of Rs.11,93,56,431/-.

3. A Common Judgment which was passed in C.S.No.510 of 2006 and O.P.Nos.735 and 735 of 2024 by a Single Judge of this Court on 07.03.2025 wherein, consequent to Mediation, a decree had been passed dividing the aforesaid amount to each one of the claimants, subsequently, by Judgment dated 30.04.2025 the amount had been credited to the suit.

4. This application has therefore been filed to withdraw the share of this claimant which amount is lying in the Court deposit. The Judgment dated 07.03.2025 is still in force and I am not informed about any appeal being filed challenging the same. As a matter of fact, it has been passed pursuant to the settlement reached in Mediation and therefore there is remote possibility of an appeal ever being filed.

5. In view of that particular fact, this application stands allowed.

6. Registry is directed to issue necessary cheque in the name of the 2/4

applicant in accordance with the Rules.
