ORDER

The petitioner who was arrested and remanded to judicial custody on 14.06.2024 for the offence punishable under Section 408 I.P.C. in Cr.No.851 of 2022 registered on the file of the

respondent, seeks bail.

2.It is seen that the petitioner was arrested in this case and granted bail on 23.02.2023 in Crl.M.P.No.397 of 2023 on condition that the petitioner to appear before the Udumalpet Police Station daily at 10.00 a.m. for 30 days. The petitioner had not appeared before the respondent Police and not co-operated during investigation. Thereafter the respondent Police had filed a petition seeking cancellation of bail in Crl.M.P.No.656 of 2023 and the learned Principal Sessions Judge cancelled the bail against which the petitioner had approached this Court and obtained an order on 28.02.2024 in Crl.M.P.No.1742 of 2024 with a condition. Again, petitioner had not complied with the condition. In the meanwhile, the petitioner had threatened the witnesses and cases in Cr.No.258 of 2023 and Cr.No.259 of 2023 have been registered.

The petitioner giving reason that he was remanded in another case that is the reason for not appearing before the lower Court has been considered by the trial Court while cancelling the earlier bail granted in Crl.M.P.No.52 of 2024, now in this case two witnesses had been examined and identified the petitioner and support the case of the prosecution. The case is posed for examination of L.W.3 to L.W.6 on 01.08.2025 and there are only a few more witnesses. The trial itself can be completed within a stipulated time. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
