This Criminal Original Petition is filed seeking a direction to the second respondent-Police not to harass the petitioner. 1/5

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for respondents and perused the materials available on record.

3. The learned counsel for the petitioner submitted that the petitioner is the landlord and let out a house to one Mahkali on a monthly rent basis situate at No.54, Abirami Avenue, Near Teachers Colony, Kulathupalayam Planagari Village, Avinashi Taluk, Tiruppur. Since there was a dispute arose between the petitioner and said Mahkali and his family members, the petitioner demanded to vacate the premises, but the said Mahkali lodged a false complaint against the petitioner. He further submitted that the dispute between the petitioner/landlord and de-facto complainant/tenant, which is purely civil in nature, in which the second respondent/Police is unnecessarily interfering and trying to give a criminal colour and harassing the petitioner on the guise of enquiry.

4. Learned Government Advocate (Crl.Side) appearing for the respondents-Police, on instructions, submitted that on receipt of the complaint from the de-facto complainant, the second respondent-Police 2/5

issued summons to the petitioner for enquiry and after conducting preliminary enquiry, it was found that the dispute between the parties is civil in nature and hence, the said complaint was closed. Therefore, there is no harassment as alleged by the petitioner.

5. In view of the above submission made by the learned Government Advocate (Crl.Side), the Criminal Original Petition is closed.
