The petitioner, who is arrayed as A-1, apprehends arrest at the hands of the respondent police, in pursuance of the Non-Bailable Warrant issued on 09.04.2012 by the learned Judicial Magistrate-II, Tiruppur in connection with a case in C.C.No.785 of 2011 for the alleged offences punishable under Section 392 of IPC, in Crime No.787 of 2011 on the file of the respondent police and hence, seeks anticipatory bail.

2.The learned counsel appearing for the petitioner submitted that the name of the Accused does not find place in the FIR and while filing charge sheet the respondent has shown the petitioner as an absconding accused. Therefore the non-bailable warrant came to be issued against him. The learned counsel further submitted that the petitioner undertakes to appear before the trial court for all future dates without fail. 3.Heard the learned Government Advocate (Criminal side) appearing for the respondent.

4.Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate-II, Tiruppur, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Sessions Judge concerned and on further condition that the petitioner shall pay a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) towards donation to the Ta miln adu Haritan S e v a k S a n gh, No. 5 8 , Ve nk at an ar ay an a Ro ad, T.N a g ar, Ch enn ai - 6 0 0 0 1 7 , Phon e N o. 9 9 9 4 6 9 7 4 3 3 , by way of Cheque/Demand Draft to show his bonafide and the petitioner shall appear before the trial court in connection with a case in C.C.No.769 of 2011 for all future hearings without fail. Except on those days his absence is condoned by filing a petition under Section 317 Cr.P.C. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. 1 7. 0 3. 2 0 1 6 smi
