ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences under sections 417, 419, 420, 465, 466, 468, 471 & 120(B) of the Indian Penal Code, 1860, in Crime No.64 of 2021 seeks anticipatory bail. 2.The case of the prosecution is that in the year 2016, the defacto complainant had approached one Raja for the purpose of purchasing a land in Survey No.49/4B, 49/5 in land No.70A. It is alleged that the the price of the land was fixed by A1 for sum of Rs.22,50,000/-. and the defacto complainant had paid the amount in two installments to the petitioner. Thereafter, the defacto complainant came to know that the land belongs to some other person. Hence, the defacto complainant lodged a complaint against the petitioner.
3.The learned counsel appearing for the petitioner submits that the petitioner is no way connected with the occurrence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor submits that the investigation is at initial stage. Hence, he vehemently opposed grant of anticipatory bail to the petitioner . https://hcservices.ecourts.gov.in/hcservices/
5. Considering the facts and circumstances of the case and also considering that detailed investigation is needed, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 10/12/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
