This petition has been filed to direct the Special Court for the cases under PC Act, Chennai to return the petitioner's passport bearing No.K4347623 which was surrendered as per the order made in Crl.O.P.No.9946 of 2018 dated 13.04.2018.

2. The learned Counsel for the petitioner would contend that as per the order of this Court in Crl.O.P.No.9946 of 2018 dated 13.04.2018, the petitioner was surrendered his passport before the Special Court for the cases under PC Act, Chennai. The passport is in the custody of the Court and the same has to be renewed. Now, the petitioner wants to renew his passport. Hence, the petitioner filed the present petition to direct the Special Court for the cases under PC Act, Chennai to return the petitioner's passport bearing No.K4347623 and also undertakes to return the passport after renewal.

3. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any serious objections.

4. Considering the submission of the learned Counsel for the petitioner that the

petitioner is want of the passport for renewal purpose and also considering the undertaking given by the petitioner that he would return the passport immediately after renewal. This Court is directed the learned Special Court for the cases under PC Act, Chennai to return the petitioner's passport bearing No.K4347623 and the petitioner is also directed to surrender his passport to the Special Court for the cases under PC Act, Chennai within a period of three months from the date of receipt of the passport.

5. With the above direction, this Criminal Miscellaneous petition is allowed. 01.10.2024 gvn To :
