O R D E R
This Writ Petition has been filed seeking for a direction to the respondents 1 to 6 to consider the objection of the petitioner dated 07.08.2024 with regard to providing electricity connection to the respondents 7 to 9 in the disputed land in S.No.531/2, situated at Sandhukadu, Mallikundam Village, Mettur Taluk, Salem District, till the disposal of the suit filed by the respondents 7 and 8 in O.S.No.134 of 2020.
2. The learned counsel appearing for the petitioner submits that there was a civil dispute between the petitioner and the respondents 7 and 8 relating to S.No.531/2, situated at Sandhukadu, Mallikundam Village, Mettur Taluk, Salem District, and a suit in O.S.No.134 of 2020 filed by the respondents 7 and 8 is pending. During the pendency of the suit, the
respondents 7 and 8 made an application for providing electricity service connection to the disputed property, for which, the petitioner has made an objection on 07.08.2024, however, it has not been considered so far. Hence, this writ petition has been filed.
3. The learned counsel appearing for the petitioner submits that it would suffice, if this Court directs the respondents 3 to 5 to consider the petitioner's objection dated 07.08.2024 within a time fixed by this Court.
4. Heard the learned counsel appearing for the petitioner, the learned counsel appearing for the respondents 1 to 6. Since no adverse order is going to be passed against the respondents 7 to 9, notice to the respondents 7 to 9 is dispensed with.
5. In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the respondents 3 to 5 to consider the petitioner's objection
dated 07.08.2024 and pass appropriate orders, after providing opportunity to the petitioner and the respondent Nos.7 to 9, as expeditiously as possible.
6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Connected miscellaneous petition is closed. 28.08.2024 NCC: Yes / No Index : Yes / No Speaking Order : Yes / No ssb To
