The petitioner, who is the sole accused, was arrested and remanded to judicial custody on 08.02.2016 for the alleged offence punishable under Section 8 of Protection of Children from Sexual Offences Act, in Crime No.01 of 2016 on the file of the respondent police and hence, seeks bail 2.The case of the prosecution is that the accused has committed sexual assault on the minor girl aged about 8 years. 3.The learned counsel appearing for the petitioner would submit that the petitioner is a landlord and the defacto complainant is the tenant under him and due to dispute arose between them, the petitioner has been falsely implicated in this case. He further submitted that at the time of occurrence, the petitioner was not available in the scene of occurrence and he was working in his office at Simson Group as Accounts Executive.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the investigation is at initial stage and as per the complaint, the accused misbehaved with the minor girl aged about 8 years.

5. Considering the above facts and circumstances of the case and also considering the fact that the investigation is at initial stage, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
