This writ petition has been filed for the issue of writ of mandamus directing the 5th respondent to consider the representation made by the petitioner on 22.02.2024, wherein the petitioner has sought for bringing her in the regular time scale of pay as per the relevant Government Orders.
2.Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents. 2/6
3.The case of the petitioner is that she was appointed as N.M.R. in the year 1996. Subsequently, she was absorbed as a water supply motor operator on consolidated basis by the Executive Officer, Ponneri Town Panchayat in the year 2000. Thereafter, the Director of Town Panchayat sanctioned several posts through proceedings dated 20.06.2000. Several Government Orders were also issued which contemplated that the concerned persons must by brought within regular time scale of pay after completion of three years from the date of appointment on consolidated pay basis. According to the petitioner, she fulfills those requirements and therefore, representation was given to the 5th respondent to bring the petitioner in the regular time scale of pay. Since, the same was not considered, the present writ petition has been filed. 4.
Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the 5th respondent to deal with the representation made by the petitioner on its own merits and in accordance with law and in line with the relevant Government Orders and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.
5.The petitioner is directed to make a fresh representation to the 5th respondent along with all the relevant documents and also a copy of this order.
6.Accordingly, this Writ Petition is disposed of with the above directions. No costs.
