Respondents Prayer: This Writ petition has been filed under Article 226 of Constitution of India, seeking a Writ of Certiorari Mandamus to call for the records on the file of the 2nd respondent in Proceedings No.KBL.ERD.PF.588.OR.1251/2003-04 dated 09.07.2003 and quash the same in so far as the petitioner is concerned and further direct the 1st and 2nd respondents to apply the guidelines issued by the 3rd respondent.

O R D E R

This relief sought for in this writ petition is to call for the records on the file of the 2nd respondent in Proceedings No.KBL.ERD.PF.588.OR.1251/2003-04 dated 09.07.2003 and quash the same in so far as the petitioner is concerned and further direct the 1st and 2nd respondents to apply the guidelines issued by the 3rd respondent.

2. Since the petition is purely challenging the order of the notice issued under Section 13(2) r/w Section 13(3) of the Securitisation & Reconstruction of Financial Assets and Enforcement of Seecurity Interest Act, 2002 and the same is pending for more than fifteen years before this Court. The learned counsel for the respondents would submit that the petitioner had settled their disputes with the second respondent Bank. Hence there is nothing survives in the writ petition.

3. Recording the submission made by the learned counsel for the respondents, this writ petition is dismissed as infructuous. Consequently, Connected Miscellaneous petition is closed. No costs.
