ORDER

The petitioner has come forward with this petition under Section 482 of Code of Criminal Procedure, seeking a direction to the respondent police to file a final report in Crime No.2531 of 2011.

2. Heard the submissions made by the learned counsel appearing on either side.

3. The learned counsel for the petitioner would submit that on the basis of the complaint given by the petitioner, a case has been registered in Crime No.2531 of 2011 for the offences punishable under Sections 468, 471, 420 and 506(ii) of I.P.C. However, the respondent has not shown any interest to investigate the matter and lay a final report. Hence, the petitioner has come up with the present petition for the relief as stated above.

4. At this juncture, the learned Additional Public Prosecutor appearing for the respondent would submit that investigation has been completed, charge sheet is ready and the same has to be filed before the Land Grabbing Court, but because https://hcservices.ecourts.gov.in/hcservices/

of the case pending before the Apex Court challenging the order setting aside the G.O., they are not able to file the final report. He would also submit that a direction may be issued to the learned Judicial Magistrate, Dharapuram to receive the final report in Cr.No.2531 of 2011.

5. Considering the above submissions, the respondent is directed to file a final report in Crime No.2531 of 2011 within a period of one month from the date of receipt of copy of this order before the learned Judicial Magistrate, Dharapuram. The learned Magistrate is also directed to receive the final report and take cognizance of the offence, if it is otherwise in order.

6. The Criminal Original Petition is disposed of with the above direction.
