O R D E R

This Contempt case has been filed to punish the respondent for wilful disobedience and non compliance of the order of this Court passed in W.P.No.13160 of 2020 dated 11.12.2024.

2. When the Contempt case is taken up for hearing today, the learned

counsel for the petitioner submits that though the respondents have passed the orders purported to be in compliance to the directions of this Court vide proceedings dated 26.08.2025, the aforesaid proceedings is against the order of the Hon'ble Supreme Court and as such, the order of this Court dated 11.12.2024 has not been complied with.

The learned Government Advocate submitted that since the respondents have passed the order as directed by this Court and if the petitioner is aggrieved by the same, he has to assail the order of the respondents by filing a separate petition and cannot seek to assail the said order before this Court in Contempt case.

4. This Court, while disposing the Writ Petition in W.P.No. 13160 of 2020 vide order dated 11.12.2024, had set aside the memo No.20305/2018/F3 dated 05.11.2019 and remitted the matter back to the second respondent for a fresh consideration on merits and in accordance with law and pass orders, within a period of 12 weeks from the receipt of the said order.

5. Pursuant to the above directions of this Court dated 11.12.2024, the

respondents have passed the order now on 26.08.2025 which according to the petitioner is not in compliance with the law laid down by the Hon'ble Apex Court. However, the said issue cannot be considered in this Contempt Petition.

6. Since, the respondents now claim to have passed the order on 26.08.2025, though it is not to the satisfaction of the petitioner, the petitioner has to work out his remedies against the said order, if it is contrary to the law laid down by the Hon'ble Apex Court. In view of the compliance with the directions of this Court by the respondents on 26.08.2025, this Court is of the view that there is no necessity to proceed further with the Contempt proceedings.
