Heard Mr. R.Sankarasubbu, Learned Counsel for the Petitioner and Mr. P.Balathandayutham, Learned Special Government Pleader appearing for the Respondents and perused the materials placed on record, apart from the pleadings of the parties.

The Writ Petition has been filed for directing the Respondents to consider the representation dated 27.09.2022 made by the Petitioner in accordance with law by opening three price bids of tenders made in Na. Ka. No. 5182/2021/A.16 dated 02.07.2022, Na. Ka. No. 2601/2022/A.14 dated 17.07.2022 and Na. Ka. No. 5182/2021/A.18 dated 21.08.2022 on the file of the Second and Third Respondents.

The Third Respondent has filed Status Report dated 17.10.2022 stating that some of the contracts have been awarded to the Petitioner in the tender. In such circumstances, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition reserving the rights of the Petitioner to 2/4

challenge the proceedings awarding contracts to other persons before the proper forum in the manner recognized by law and he has made an endorsement to that effect in the court record.

In view of the same, the Writ Petition is dismissed as withdrawn with the aforesaid clarifications. Consequently, the connected Miscellaneous Petitions are closed. No costs.
