Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus or any other Writ or Order or Direction in the nature of Writ by directing the 1st respondent to issue no objection certificate for the purpose of renewal of petitioner's license based on petitioner's

representation dated 05.10.2021 and further consequently direct the 2nd respondent to renew the license of M/s.Taksu Bali Spa Private Limited,license No.223049932 based on petitioner's application dted 19.02.2021.

ORDER

This Writ Petition has been filed to direct the 1st respondent to issue "No Objection Certificate" for the purpose of renewal of petitioner's license and to direct the 2nd respondent to renew the license of the petitioner to run M/s. Taksu Bali Spa Private Limited, Represented by its Director, Y.Gnanaganesh, 130, Venkatasamy Road, R.S.Puram, Coimbatore - 641002.

2. The learned Additional Public Prosecutor appearing for the respondents on instructions submitted that the petitioner is already running "M/s. Taksu Bali Spa Private Limited" and the Police are under the impression that already "No Objection Certificate" was given by the Police. If the petitioner has not obtained any "No Objection Certificate", the petitioner can be directed to approach the 1st respondent and the 1st respondent will consider the grant of "No Objection Certificate" to the petitioner.

3. Recording the submission of the learned Additional Public Prosecutor, this Writ Petition is disposed of with a direction to the petitioner to make a representation to the 1st respondent seeking for "No Objection Certificate" for running the business and the 1st respondent on receipt of the representation shall consider the same and issue "No Objection Certificate" if he satisfies all the requirements. In the event of "No Objection Certificate" is granted, the respondents shall not, thereafter interfere with the business of the petitioner, until it is run in accordance with law. No costs.
