W.M.P.No.30155 of 2025 in W.P.No.26831 of 2025 W.M.P.No.30155 of 2025 in W.P.No.26831 of 2025 M.SUNDAR,J., and HEMANT CHANDANGOUDAR, J., (Order of the Court was made by M.SUNDAR.J.,) Captioned 'Writ Miscellaneous Petition' ['WMP' for the sake of brevity] has been filed with a prayer to dispense with the production of original 'proceedings dated 08.07.2025 issued by the first respondent' [hereinafter 'impugned order' for the sake of brevity, convenience and clarity].
2. Learned counsel for writ petitioner submits that only from the communication of the third respondent to jurisdictional Inspector of Police, Chinnaselam dated 11.07.2025, which was pasted on the petitioner's premises, wherein there is a reference to the impugned order, the petitioner came to know about the impugned order and hence, he could not file the original impugned order. Learned counsel drew the attention of this Court to a portion of paragraph 5 of the support affidavit, which reads as follows:
''5.........At this juncture, the 3rd respondent M.SUNDAR,J., 1/2 https://www.mhc.tn.gov.in/judis
W.M.P.No.30155 of 2025 in W.P.No.26831 of 2025 and HEMANT CHANDANGOUDAR, J., communication letter to the Inspector of Police, Chinnaselam vide Na.Ka.No.4/680/2025 dated 11.07.2025 has been pasted on the wall of the petitioner. In the above communication letter, the 1st respondent proceedings date has been mentioned as 08.07.2025. But the 3rd respondent failed to serve the impugned proceedings prior to this communication. Moreover, the copy of the impugned proceedings prior to this communication. Moreover, the copy of the impugned proceedings served only on 14.07.2025 by the 4th respondent. '
3. Considering the facts and circumstances of the case on hand and taking note of the nature of the matter, aforementioned reason is accepted.
