This Application has been filed by the applicant / petitioner, who is the father of the minor child seeking permission to grant interim custody of the minor child Samyukthavarshini aged 8 years. 2.
Today when the matter was taken up in the chambers, the child was present. The petitioner and the respondent were also present along with their learned counsels.

After hearing the learned counsels appearing on either side, this Court had some interaction with the child. It is seen that the child is very emotional and she is not inclined to have even a little interaction with the petitioner. The child has not seen the petitioner right from her birth and she continues to be under the custody of the respondent. When the child was advised to have a little interaction with the petitioner, she got disturbed and started to cry inconsolably. When such is the psychological state of the child, it is difficult to grant any order for visitation in the existing situation. So, it is advisable for the parties to continue to participate in the trial. 1/3

In view of the psychological and emotional condition of the child, the interim relief sought by the petitioner could not be granted. Hence, the application in A.No.5987 of 2022 is closed. 08.09.2023 sri 2/3
