(Made by P.N.PRAKASH, J.) When the matter was taken up for hearing, the learned Additional Public Prosecutor brought to the notice of this Court that when the matter was posted for judgment by the trial Court on 02.12.2020, the accused had absconded and so, NBW was issued. The petitioner surrendered before the trial Court on 06.10.2021 and prayed for recalling the NBW.
2. Since the petitioner was in abscondance for a year, we expressed our reservation for granting suspension of sentence. Hence, learned counsel for the petitioner sought permission to withdraw the petition and has made an endorsement to that effect. Recording the said endorsement, this petition is dismissed as withdrawn.
