When the matter is taken up of hearing today, the learned Government Advocate (Crl. Side) would submit that though the petitioner is arrayed as seventh accused in this case, the investigation reveals that he has been inducted in the partnership Company without his knowledge. During the course of investigation, it has come to light that the offence has committed without knowledge of the petitioner.

2. He would further submit that notice has been issued to the petitioner under Section 41 Cr.P.C., and the petitioner has been regularly appearing for enquiry. Therefore, the respondent has no intention to arrest the petitioner.

3. In view of the above, the criminal original petition is closed. However, it is made clear that the petitioner shall co-operate with the investigation.
