ORDER

This Writ Petition (Criminal) has been filed seeking a direction to the respondents 1 to 3 to take action against the respondents 4 to 9 based on the representation submitted by the petitioner dated 06.06.2025. 2.

Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner's family members owned properties comprised in Survey Nos.12/2A, 12/5, 16/1 and 16/2 under Joint Patta No.70, situated at Marikkampalli Village, Krishnagiri District and the land comprised in Survey No.93/2A under Joint Patta No.80 situated at Sembadamuthur Village,

Krishnagiri District. The said properties were acquired by the petitioner's family members through a partition among the family members and the respondents 10 to 12 herein, who are none other than the brothers of the petitioner's husband. In respect of the said properties, there are dispute between them. While being so, the respondents 4 to 9 refused to collect the tax from the petitioner's family for the Pongal Festival celebration, which was held on 09.01.2025. Therefore, the petitioner submitted a representation before the first and second respondents on 06.02.2025.

A perusal of the counter affidavit filed by the third respondent and the submissions made by the learned Counsel for Government of Tamil Nadu (Criminal Side) reveals that the petitioner had collected tax to the tune of Rs.2,000/- to participate in all the festivals of their village. Subsequently, a meeting was conducted, in which the matter was resolved between them. Further, the dispute between the petitioner's family members and the respondents 10 to 12 herein is with regard to the property. Therefore, there is no question of excommunication of the petitioner and her family members from the said village.

In view of the above, in future, if there is any refusal to collect tax from the petitioner and her family members, she is at liberty to lodge a fresh complaint before the first respondent. On receipt of such complaint, the first respondent is directed to take appropriate action against the person who refuses to collect the tax by excommunicating the petitioner and her family members. 6.

With the above observation and direction, this Writ Petition stands dismissed. No costs.
