The petitioner who was arrested and remanded to judicial custody on 03.10.2020 for an offence under Sections 8(c) r/w 20 (b) (ii) (B), 25, 29(1) of NDPS Act in Crime No.1169 of 2020, seeks bail.

2. It is the case of the prosecution that accused in this case were found to be in possession of 25-1/2 Kgs of Ganga out of which 21 Kgs of Ganja were in the possession of A1 & A2. The petitioner is arrayed as A2 in the case.

3. It is seen from records that previous bail petitions were dismissed considering the quantity of the contraband seized.

In view of the fact that the quantity of contraband seized is of commercial quatity for which bail cannot be granted in view of the bar under Section 37 of the NDPS Act and there being no change of circumstance arises for considering the present bail petition, this Court is not inclined to grant bail to the petitioner herein. Accordingly, this Criminal Original Petition is dismissed.
