The learned counsel appearing for the petitioner would submit that the complaint was dismissed under Section 256(1) Cr.P.C., and though he had sufficient reason for non appearing before the Trial Court on the particular date, the learned Judicial Magistrate failed to consider the same and dismissed the petition under Section 256(1) Cr.P.C.
2. Considering the submission made by the learned counsel appearing for the petitioner and there are arguable points in the main appeal, this Court is inclined to grant leave.
3. Registry is directed to number the appeal, if it is otherwise in order.
4. If the appeal is taken on file, the learned counsel for the appellant is directed to serve notice to the respondent as well as the learned counsel who appeared in this OP.
