Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 2 to 4 consider and pass orders on the petitioner's representation dated 28.11.2016 requesting to operate State Transport Corporation buses both Tamil Nadu and Andhra Pradesh and Private buses having permit to operate buses from Krishnagiri to Kuppam via Maharajakadai instead of operating buses from Krishnagiri to Kuppam via Government Arts College, after affording an opportunity of personal hearing to the petitioner. ORDER
(Order of the court was made by the Hon'ble Chief Justice) We have heard learned counsel for the petitioner.
2. Learned counsel for the petitioner submits that the buses are operated by the fifth respondent/Corporation on the route
Krishnagiri to Kuppam via Government Arts College, instead of Krishnagiri to Kuppam via Maharajakadai, which is the approved route. According to learned counsel, for a month or so, the fifth respondent operates the vehicles properly through Maharajakadai after the orders are passed by this court and subsequently again the said service is disrupted.
3. Learned Special Government Pleader has placed a communication on record to suggest that State Transport Corporation buses and private buses are operating on the route Krishnagiri to Kuppam via Maharajakadai. It is further stated that a Motor Vehicles Inspector is also deputed to monitor that the buses are plied properly.
4. It is submitted by learned counsel for the petitioner that only one or two buses are plied through Maharajakadai. According to the report submitted by learned Special Government Pleader, number of buses are plied on the said route.
5. In view of that, at present, it cannot be said that the grievance of the petitioner subsists. If in future difficulties are faced, the petitioner will be at liberty to take up a fresh cause. With these observations, the writ petition is disposed of. There will be no order as to costs. Consequently, W.M.P.Nos.7677 and 19648 of 2017 are closed.
