Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd, 3rd and 4th respondent to consider the petitioners application dated 12.07.2021 and consequently direct the 2nd, 3rd and 4th respondent to issue / renew trade license for the petitioners shop Anantha Thai Spa situated at No.20/1, Basement Floor, Crystal Lawns, Wallace Graden, 2nd Street, Nungambakkam, Chennai 600 034 without insisting NOC from the 1st respondent within the time limit fixed by this Court.

O R D E R

The relief sought for in the present writ petition is to direct the 2nd, 3rd and 4th respondent to consider the petitioners application dated 12.07.2021 and consequently direct the 2nd, 3rd and 4th respondent to issue / renew trade license for the petitioners shop Anantha Thai Spa situated at No.20/1, Basement Floor, Crystal Lawns, Wallace Graden, 2nd Street, Nungambakkam, Chennai 600 034 without insisting NOC from the 1st respondent.

2. Learned Standing Counsel appearing for the Chennai Corporation made submissions that the petitioner has not submitted the required NOC from the police authorities.

3. It is needless to state that the petitioner is bound to submit all necessary documents for the purpose of considering the application. In the absence of production of required certificates, the authorities competent will not be in a position to consider the application. The authorities competent is also expected to consider the applications in accordance with the provisions of the Act and Rules and by conducting proper inspections. Therefore, the petitioner is at liberty to submit all required documents before the competent authorities and in the event of submitting all required documents, the respondents shall conduct the inspection and consider the application on merits and in accordance with law.

4. With the above observations, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
