O R D E R

The petitioners herein apprehend arrest at the hands of the respondent police for the offences punishable under Sections 120 B, 409, 408, 468, 471, 477A and 420 of IPC read with Section 34 of IPC in Crime No.01 of 2025, on the file of the respondent Police, seek anticipatory bail.

It is seen that, this Court on 11.11.2025 based on the undertaking given by the petitioners, directed them to repay a sum of Rs.79,19,162/- within a period of two months and granted interim anticipatory and thereafter the matter was posted for compliance on 20.01.2026, this Court passed the following order:

This Court vide order dated 11.11.2025, based on the undertaking given by the petitioners directed them to repay a sum of Rs.79,19,162/- within a period of two months and granted interim anticipatory bail. When the matter was listed for hearing on 02.01.2026 for passing further orders, it was reported that they need some more time and accordingly the matter was adjourned today ie., on 20.01.2026. Today, there is no representation for the petitioner. This Court also called for report from the concerned Judicial Magistrate regarding the compliance of the conditions imposed by this Court in 11.11.2025. On perusal of the report, it revealed that, none of the

petitioners have complied with the conditions with regard to repayment. Since, the interim order has not been complied with, this Court is of the view that the interim order is liable to be cancelled and accordingly, interim anticipatory bail granted to the petitioners is hereby cancelled.

2. List the matter for further hearing on 27.01.2026. Today, when the matter was called for hearing, on merits it reveals that huge amount has been swindled by fabrication of records, falsification of accounts and total amount involved in this case is Rs.2,14,90,673/- and the petitioner herein has alone cheated a sum of Rs.79,19,162/-. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
