O R D E R

This Criminal Original Petition has been filed challenging the order passed by the Court below dismissing the petition filed u/s.311 Cr.P.C. to recall PW-1 and PW-2 for further cross-examination.

2. Heard Mr.C.D.Sugumar, learned counsel for petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor appearing for respondent.

3. On carefully reading the order passed by the Court below, it is seen that the petitioner had filed a similar petition in Crl.M.P.No.97 of 2022 and the said petition came to be dismissed. Aggrieved by the same, the petitioner had filed Crl.O.P.No.7322 of 2022 before this Court and this Court dismissed the said petition by order dated 13.09.2022. Once again, a similar petition has been filed before the Court below. The Court below has given sufficient reasons to dismiss the petition. This Court does not find any illegality or infirmity in the order passed by the Court below and it does not warrant the interference of this Court.

In the light of the above discussion, this Criminal Original Petition is 2/4
