Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to consider petitioner's representation dated 13.07.2023 as per the provisions at the Street Vendors (Protection of Livelihood Regulations) Act, 2014, made for granting permission/certificate of vending and till such time not to disturb with the running of the petitioner's bunk shop which running at opposite to Tube Products of India, CTH Road, Avadi - 109.

O R D E R

The petitioner herein seeks a direction to the second respondent to consider his representation dated 13.07.2023 in the light of the provisions of Street Vendors (Protection of Livelihood Regulations) Act, 2014 and grant permission for running a bunk shop opposite to Tube Products of India, CTH Road, Avadi, Chennai.

2. It is the case of the petitioner that he is a differently abled person and he has been running a bunk shop opposite to Tube Products of India, CTH Road, Avadi. He has been earning his livelihood by selling tea in the said shop. The petitioner submitted a representation dated 13.07.2023 to the second respondent seeking his permission to run the bunk shop along with necessary documents and the same has not been considered till date. Therefore, the petitioner is before this Court. 2/4

3. Mr.S.Anitha, learned Special Government Pleader takes notice for the first respondent and Mr.R.Gopinath, learned Standing Counsel takes notice for the second respondent corporation.

4. The learned Standing Counsel appearing for the second respondent submitted that already Town Committees have been constituted and they are in process of considering the similar applications.

5. In the light of the stand taken by the second respondent, this Court is inclined to issue a direction to second respondent to consider the request of the petitioner in his representation dated 13.07.2023 on merits and pass final orders within a period of six weeks from the date of receipt of copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
