COMMON ORDER W.P.No.26428 of 2023 is filed seeking to direct the 2nd respondent to consider and pass order on petitioners representation dated 09.06.2023 which is seeking cancellation of mortgage deed, returned of his property document and repay the deducted amount of Rs.68,271/- along with earnest leave surrender amount.

W.P.No.26431 of 2023 is filed seeking to direct the 2nd respondent to consider and pass order on petitioners representation dated 09.06.2023 which is seeking cancellation of mortgage deed, returned of his property document and repay the deducted amount of Rs.1,39,194/- along with earnest leave surrender amount.

W.P.No.26435 of 2023 is filed seeking to direct the 2nd respondent to consider and pass order on petitioners representation dated 09.06.2023 which is seeking cancellation of mortgage deed, returned of his property document and repay the deducted amount of Rs.85,035/- along with earnest leave surrender amount of Rs.38,368/- W.P.No.26436 of 2023 is filed seeking to direct the 2nd respondent to consider and pass order on petitioners representation dated 09.06.2023 which 2/6

is seeking cancellation of mortgage deed, returned of his property document and repay the deducted amount of Rs.33,915/- along with earnest leave surrender amount of Rs.80,500/-.

W.P.No.26437 of 2023 is filed seeking to direct the 2nd respondent to consider and pass order on petitioners representation dated 09.06.2023 which is seeking to repay the deducted amount of Rs.1,02,104/- along with earnest leave surrender amount.

2. Since, the facts and circumstances of these cases are identical in nature, these cases are disposed of by way of this Common Order.

3. The case of the writ petitioners are that they availed housing loan from the respondent Corporation by mortgaging the property and had repaid the entire loan. Despite closure of loan, the mortgage has not been cancelled and further, due to audit objections in respect of damaged goony bag to the respondent corporation in the Nagapattinam Region, the second respondent deducted amounts from the petitioners salary. Hence, they submitted representations dated 09.06.2023 seeking to cancel the mortgage deed, return the property documents, earnest leave surrender amount and deducted 3/6

amounts, which are pending without consideration till date. Hence, these writ petitions.

4. Heard both sides and perused the materials placed on record. Considering the limited relief sought for in these writ petitions, this Court directs the second respondent to consider the representations of the petitioners dated 09.06.2023 and pass appropriate orders on merits and in accordance with law within a period of two months from the date of receipt of a copy of this Order.
