Criminal Original Petition filed under Section 482 Cr.P.C., to direct the 3rd respondent police to alter the offence as to include under Sections 149, 302 r/w 120(B) of IPC in Crime No.218 of 2017 pending on the file of 3rd respondent police.

ORDER
This petition has been filed to direct the 3rd respondent police to alter the offence as to include under Sections 149, 302 r/w 120(B) of IPC in Crime No.218 of 2017 pending on the file of 3rd respondent police.

2.The learned Additional Public Prosecutor would submit that investigation in Crime No.218 of 2017 has already been completed in the year 2017 itself and further action also dropped. Therefore, alteration of offences does not arise. 3.In view of the submission made by the learned Additional Public Prosecutor, the Criminal Original Petition is dismissed. However, the 3rd respondent is directed to send a copy of the referred charge sheet to the petitioner herein, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the petitioner is at liberty to file a protest petition before the concerned Court, if so advised.
