A.No.4374 of 2023 in OP.Dr.No.32575 of 2022 R.N.MANJULA, J., This application has been filed to refund the sum of Rs.25,000/- deposited towards succession duty in OP.D.No.32575 of 2022 for grant of Succession Certificate by issue of cheque in favour of the applicant namely C.M.Murali.

2.The learned counsel for the petitioner submitted that the petitioner is not interested in pursuing the case and hence, he had taken over this application to refund a sum of Rs.25,000/- towards the succession duty deposited towards succession duty in OP.D.No.32575 of 2022 for grant of Succession Certificate.

3. The original petition filed by the petitioner is not yet numbered and hence, there is no purpose in retaining the deposit of Rs.25,000/- towards succession duty. Hence this petition is ordered as per mandate of Sec. 379(3) of Indian Succession Act, 1925.
