PRAYER: Petition filed under Section 24 of the Code of Civil Procedure, to withdraw the case in H.M.O.P.No.2608 of 2020 pending before the VII Family, Court, Chennai, and the same may be transferred to the Sub-Court, Poonamallee for joint trial with the case in H.M.O.P.No.820 of 2021, pending on the file of the Sub Court Poonamallee.

ORDER

The above application is filed seeking transfer of the proceedings for divorce filed by the husband on the file of the VII-Family Court, Chennai, to the file of the Subordinate Court Poonamallee, to be jointly tried with H.M.O.P. No.820 of 2021, filed by the petitioner/wife for Restitution of Conjugal Rights.

2. The respondent who has entered appearance through counsel has no objection to the H.M.O.P. No.820 of 2021, being transferred and accordingly, the Transfer Civil Miscellaneous Petition is allowed and H.M.O.P. No.2608 of 2020, pending on the file of the VII- Family Court Chennai is withdrawn and transfer to the file of the Subordinate Court Poonamallee, to be tried along with H.M.O.P.No.820 of 2021. No costs. Consequently, connected Miscellaneous Petition is closed.
