Transfer Civil Miscellaneous Petition is filed under Section 24 of Civil Procedure Code, to withdraw the H.M.O.P.No.142 of 2021 from the file of the Sub-Court, Harur, Dharmapuri District and transfer the same to the Sub-Court, Uthangarai, Krishnagiri District.

O R D E R

This Transfer Civil Miscellaneous Petition is filed seeking to withdraw the H.M.O.P.No.142 of 2021 from the file of the SubCourt, Harur, Dharmapuri District and transfer the same to the Sub-Court, Uthangarai, Krishnagiri District.

2. The Transfer is sought for by the petitioner/wife on the ground that she is residing in Uthangarai Taluk, along with her two minor children with her parents. It is her grievance that she finds it very difficult to travel along with her two minor children from Uthangarai to Harur for the hearing, since the respondent/husband is not maintaining herself and her children. Therefore, she is only depending on her aged mother to meet their day to day expenses. The travel to Harur would be an additional financial burden on her.

3. Heard the learned counsel for the petitioner and perused the materials available on record. The respondent, though served, https://hcservices.ecourts.gov.in/hcservices/

has not entered appearance.

4. Considering the reasons given and the fact that the wife is residing within the Jurisdiction of the Sub-Court, Uthangarai, this Court is of the considered view that the request for transfer should be allowed.

5. Accordingly, the transfer Civil Miscellaneous Petition is allowed and H.M.O.P.No.142 of 2021 pending on the file of the the Sub-Court, Harur, Dharmapuri District is withdrawn and transferred to the file of the Sub-Court, Uthangarai, Krishnagiri District. No costs. Consequently, connected civil miscellaneous petitions are closed.
