Respondent PRAYER: Criminal Revision Case is filed under Section 438 r/w 442 of BNSS, 2023, praying to set aside the order in Crl.MP.No.474 of 2025 dated 07.07.2025 passed by the learned Special Judge for EC/NDPS Act Cases, Salem, consequently direct the respondent to return the petitioner's two-wheeler namely Royal Enfield Bullet bearing registration No.TN-25-BF-1000 to the petitioner as interim custody.

O R D E R

This Criminal Revision Case has been preferred against the order in Crl.MP.No.474 of 2025 dated 07.07.2025 passed by the learned Special Judge for EC/NDPS Act Cases, Salem, thereby dismissed the petition to return the petitioner's property.

Heard, the learned counsel on either side and perused, all the materials placed before this Court.

On perusal of records, it is revealed that the petitioner, who is an accused in the aforementioned criminal case, owned a two wheeler bearing registration No.TN-25-BF-1000. While being so, the petitioner was found in possession of 'ganja' weighing 1.100 kg, which was kept in the said bike. Therefore, the respondent registered FIR in crime No.107 of 2025 for the offence punishable under Sections 8(c), 20(b)(ii) (B) and 25 of NDPS Act. Pursuant to the registration of FIR, the contraband and the vehicle were seized and produced before the trial court. Now the confiscation proceeding has been initiated against the vehicle. As such, the trial court rightly dismissed the petition and this Court finds no infirmity or illegality in the impugned order. 4.

Accordingly, this criminal revision case is dismissed.
