O R D E R

The petitioner has come forward with this petition seeking for a direction to the respondent to register a case pertaining to the petitioner's complaint dated 08.02.2016. 2.Learned counsel for the petitioner submitted that the petitioner has lodged a complaint before the respondent on 08.02.2016, for which C.S.R.No.86 of 2016 has been assigned. But the respondent has not shown any interest to enquire the matter and register the case. Hence, the petitioner has come forward with this petition for the above stated relief. 3.Resisting the same, the learned Additional Public Prosecutor, would submit that the petitioner is none other than the son of the first wife of the deceased Jayaraman. The deceased Jayaraman left his first wife, got second marriage with one Uma Maheswari and he died on 08.02.2016.

He further submitted that before his death, the said Jayaraman bequeathed all his property in favour of his second wife. Enraged against this, the present complaint has been given. He would also submitted that during enquiry, it was revealed that the death of https://hcservices.ecourts.gov.

the deceased Jayaraman was due to cardiac arrest and so, the complaint was closed on 26.02.2016. Hence, he prayed for dismissal of the petition.

4.Recording the submission made by the learned Additional Public Prosecutor that on the basis of the complaint given by the petitioner, enquiry has been conducted and it was closed on 26.02.2016 stating that the death of the deceased was only due to cardiac arrest and not homicide, the Criminal Original Petition is disposed of.
