[Order of the Court was made by R.SURESH KUMAR, J.] This civil miscellaneous petition has been filed to condone the delay of 402 days in filing the above appeal.

2. Heard the learned counsel appearing for the petitioner.

3. Since the delay is huge, this petition is ordered on terms, that the petitioner shall pay costs of Rs.2000- (Rupees Two Thousand only) to the respondent within a period of two weeks from today, failing which this petition shall stand dismissed automatically without any further reference to this Court.

4. Registry is directed to number the appeal and place the same for admission, if the papers are otherwise in order.
