ORDER
The instant writ petition has been filed directing to the respondents to consider the petitioner's representation dated 17.04.2024 in respect of stay of the departmental proceedings initiated under the proceedings in Na.No. 3956/2017pa dated 22.02.2024 till the disposal of the criminal case in Spl.CC. No. 04/2021 pending of the file of the CJM, Krishangiri.
2. The learned counsel for the petitioner would submit that as against him an FIR was registered under Sections 120-B, 167, 409, 420, 468, 471, 477-A of IPC and 13(2) r/w 13(1)(c) and (d) of the Prevention of Corruption Act. It is the further contention of the petitioner that based upon the final report filed by the
police, the case was taken on file in Spl.C.C.No.04 of 2021 before the Chief Judicial Magistrate, Krishnagiri. The trial is at advance stage. Further contention of the learned counsel for the petitioner is that during the pendency of the criminal proceedings, the respondents has issued charge memorandum, which contains same set of allegations relying upon same set of documents and evidences. Therefore, proceedings with the departmental proceedings parallely would prejudice to the petitioner's interest. Hence, the petitioner has sent representation on 17.04.2024 for stay of departmental proceedings and such representation is yet to be considered.
3. At this juncture, the learned Additional Government Pleader would submit that they will consider the representation of the petitioner according to its own merits. However, the learned Additional Government Pleader would further submit that there is no proper representation received by them.
4. In view of the same, the petitioner is given liberty to submit a fresh representation along with the required documents within a period of seven (7) days from the date of receipt of a copy of this order. On such receipt, the respondents are directed to dispose of the same within a period of six (6) weeks from thereon.
5. With the above directions, the writ petition is disposed of. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. 28-07-2025 gd Index:Yes/No Speaking/Non-speaking order Internet:Yes
