ORDER
This writ petition has been filed for the issue of writ of mandamus directing the 1 st respondent to renew the passport for the petitioner based on the application submitted by the petitioner on 30.06.2025.
2. The learned Government Advocate appearing on behalf of the 2 nd respondent submitted that a case is pending against the petitioner in C.C.No.416 of 2023 on the file of the Learned Judicial Magistrate-I, Poonamallee.
3. In the considered view of this Court, the renewal/re-issuance of the passport does not require any permission of the Court. Useful reference can be made to the judgment passed in W.A.No.902 of 2023 dated 02.06.2023. The Page No.2 of 5
Division Bench of this Court held that such permission is warranted only if the accused person wants to out of the country.
4. In view of the above, there shall be a direction to the 1 st respondent to process the application submitted by the petitioner on 30.06.2025 and renew the passport for the regular period, if the petitioner has satisfied with all the other requirements. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. However, if the petitioner wants to go out of the country, he has to necessarily seek permission of the Court where the criminal case is pending.
5. In result, this Writ Petition stands disposed of in the above terms. No costs.
