The petitioner was granted bail by this Court in C.A.No.267 of 2023 on 18.04.2023 of the other conditions one of the condition that the petitioner shall stay at Ramanathapuram and report before the Sikkal Police Station, Ramanathapuram District on the first day of every week at 10.30 a.m., until further orders. Thereafter, the petitioner filed a relaxation petition and this Court, by order, dated 27.04.2023 modified the condition directing the petitioner to appear before the E4 Kattur Police Station on the first working day of every month at 10.30 a.m., and sign until further orders. Now, this relaxation petition has been filed for the reason that the petitioner is facing some threat at the hands of his rivals.
2.The learned Additional Public Prosecutor appearing for the respondents 1 and 2 submitted that the investigation is almost at the penultimate stage and charge sheet will be filed shortly. He further submitted that there is no such threat as apprehended by the petitioner. Further, the petitioner is not complying the condition imposed by this Court Page No.1 of 3
and appropriate steps are being taken by the 2nd respondent following the judgment of the Hon'ble Apex Court in the case of "P.K.Shaji Versus State of Kerala [(2005) AIR SCW 5560]".
3.Finding no reason to entertain this Criminal Miscellaneous Petition, this Court deserves to dismiss the same. Accordingly, this petition stands dismissed.
