Crl.M.P.No.12742 of 2019 in Crl.R.C.SR.No.43119 of 2019 D.BHARATHA CHAKRAVARTHY, J., This petition has been filed to condone the delay of 111 days in filing the above Criminal Revision Case against the order dated 08.02.2019 made in M.C.No.63 of 2017 on the file of Family Court, Dharmapuri.
2.In this matter, it is seen that repeatedly attempts have been made to serve the notice. However, the Court notices have been returned on the ground that the petitioner has gone as a daily wage laborer to Bangalore and the private notices sent by the respondent have returned with an endorsement that 'intimation delivered and unclaimed'.
3.Therefore, it is further to be noted that the learned Counsel appearing before the Trial Court has also been served.
Therefore, I hold that the service is complete.
4. Considering the reasons stated in the affidavit filed in support of the petition, the delay of 111 days in filing the Criminal Revision Case in Crl.R.C.SR.No.43119 of 2019 is condoned.
5. Registry is directed to number the Crl.R.C.SR.No.43119 of 2019, if it is otherwise in order.
