The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 302 IPC subsequently altered into Sections 120(b), 458, 302 read with Section 34 of IPC, in Crime No.234 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that, on 29.06.2022, one Balasubramani was murdered by six unknown persons. Thereafter, on investigation it was came to light that, the father of the deceased person/A1 engaged other accused A2 to A6 to murder his son. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is the owner of the bakery and he is nothing to do with the alleged occurrence and further submitted . Based on the confession statement of the arrested accused/ A5 and A6, who were wording under the petitioner,he has been implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner is a close friend of A1 and he only engaged some henchmen to murder the deceased. He would further submit that earlier this Court had dismissed the anticipatory bail petition of the petitioner in Crl.O.P.No.17495 of 2022 and this is the second petition. Hence, he vehemently opposed for grant of bail to the petitioner.
5. Though earlier this Court had dismissed the anticipatory bail petition, the petitioner, without surrendering has again filed this petition. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed with cost to the tune of Rs.5,000/- (Rupees Five Thousand Only) to the credit of the Chief Justice Relief Fund, High Court, Madras. 11.10.2022 Anu Crl.O.P.No.24235 of 2022 https://www.mhc.tn.gov.in/judis
