This Criminal Original Petition has been filed by the petitioner under Section 482 of Cr.P.C., to call for the records connected with the order in Crl.R.C.No.85/2016 dated 03.03.2017 passed by the Principal District Judge, Chennai and consequently, order stoppage of the proceedings in C.C.No.752/2015 on the file of XVI Metropolitan Magistrate, George Town, Chennai as per Section 258 Cr.P.C. and set aside the same.

2.It is seen that the petitioner filed a discharge petition in Crl.M.P.No.2474 of 2015 u/s.239 Cr.P.C. to stop the entire https://hcservices.ecourts.gov.in/hcservices/

proceedings in C.C.No.752 of 2015 on the ground that the Trial court ought not have taken cognizance, since the complaint is lodged only after three years from the date of the cause of action.

3.It is also seen from the records that the defacto complainant filed a condone delay petition in Crl.M.P.No.2172 of 2012 and the same was allowed and the complaint in C.C.No.752 of 2015 was taken cognizance by the Trial Court. Therefore, this Court finds no merits in this petition and also the present revision amounts to the 2nd Revision. Hence, this petition is devoid of merits and liable to be dismissed.

4.Accordingly, this Criminal Original Petition stands dismissed.
