PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 and 2 to survey and fence the petitioner's property comprised in S.No.247/2 now subdivided as S.No.247/2A1A measuring to an extent of 1.67.25 hectares situated at Pannapalli Village, Shoolagiri Taluk, Krishnagiri District within a stipulated period by considering his representation dated 19.03.2024. O R D E R

By consent of both the learned counsel appearing for the petitioner as well as respondents, this writ petition is disposed of at the admission stage itself.

2. The petitioner herein seeks a direction to respondents 1 and 2 to survey his property situated in S.No.247/2 subdivided as S.No.247/2A1A measuring to an extent of 1.67.25 hectares situated at Pannapalli Village, Shoolagiri Taluk, Krishnagiri District by considering his representation dated 19.03.2024.

3. It is the case of the petitioner that he purchased the above mentioned property under sale deed dated 01.11.2019 and has been in possession and enjoyment of the same. The petitioner sought for survey of the above said land and the same was opposed by the 3rd respondent. Therefore, the petitioner submitted a representation on 19.03.2024 to 1st and 2nd respondents seeking survey of the land with the help of Police and the same has not been considered. Hence, the petitioner is before this Court by way of this writ 2/4

petition.

4. The learned Special Government Pleader, who is taking notice for the respondents 1 and 2, submitted that the representation of the petitioner will be considered on its' own merits within a time fixed by this Court.

5. In view of the same, without going into the merits of the claim made by the petitioner, the 1st respondent is directed to consider the representation of the petitioner dated 19.03.2024 and pass final orders on its' own merits within a period of six weeks from the date of receipt of copy of this order after issuing necessary notice to the petitioner and the 3rd respondent.

6. With the above directions, this writ petition is disposed of. No costs. 20.09.2024 Index : Yes/No nr 3/4
