O RDER This Writ Petition has been filed restraining the respondents from in any way construct compound wall in between the petitioner's land and the Link Road comprised in Survey No.398/6A1B of Veeracholapuram East Village, Kallakurichi Taluk and District.
2. Heard the learned counsel on either side and perused the materials available on record.
3. After bifurcation of the Kallakurichi District, the land which belonged to the petitioner comprised in S.No.398/6A, New S.No.398/6A1B to an extent of 44.46 cents was acquired for construction of Collectorate by a private negotiation from the petitioner, on condition that there shall not be construction of any compound wall between the property which was purchased for construction of Collectorate and the land owned by the petitioner on the western side. Now, the first respondent is putting up a compound wall in between the land which was purchased from the petitioner and the remaining land owned by the petitioner.
4. A perusal of the sale deed also revealed that after accepting the
condition imposed by the petitioner that there will not be any construction of compound wall between the property which was purchased for construction of Collectorate and the land owned by the petitioner, the sale deed was executed by the petitioner to construct the Collectorate for Kallakurichi District.
5. Therefore, the first respondent is directed to consider the case of the petitioner by conducting enquiry, after giving an opportunity of hearing to the petitioner and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of the order. Till then, the respondents are restrained from putting up any compound wall in between the petitioner's land and the long road comprised in S.No.398/6A1B situated at Veeracholapuram East Village, Kallakurichi Taluk and District.
