Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records from the 1st respondent pertaining to the impugned proceedings, R.No.888/18/81 dated 03.01.2019, quash the same and consequently, to direct the 1st respondent to reinstate the employment.

O R D E R

The petitioner has filed this writ petition challenging the impugned proceedings of the 1st respondent in R.No.888/18/81 dated 03.01.2019 and consequently, directing the 1st respondent to reinstate the employment.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.

3.The case of the petitioner is that the petitioner was given employment on the compassionate ground in the year 2009. The petitioner was suspended from service on 03.01.2019 based on the criminal case pending against him. Therefore, the petitioner sent a representation dated 09.01.2019 to the 1st respondent. However, till date, the 1st respondent has neither revoked the suspension order nor given any reply. Hence, the present writ petition.

4.At the time of arguments, the learned counsel for the petitioner submitted that the petitioner was suspended from service for a long time. Therefore, it would suffice for this Court to direct the 1st respondent to consider the petitioner's representation dated 09.01.2019 for revocation of suspension order on the ground of prolonged suspension.

5. Considering the limited request made by the petitioner, this Court hereby directs the 1st respondent to consider the petitioner's representation dated 09.01.2019 and pass appropriate orders on merits and in accordance with law, as expeditiously as possible.

6.The writ petition is accordingly disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
