PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent to not to harass the petitioner.

O R D E R

This petition has been filed to direct the respondent not to harass the petitioner.

2. The grievance of the petitioner is that the petitioner is called by the third respondent at odd hours on the guise of the enquiry for Crime No.2912 of 2021 in which the petitioner's sister Shalini is an accused. The petitioner is no way connected to the case.

3. The learned Additional Public Prosecutor submitted that the petitioner's sister Shalini is an accused in Crime No.2912 of 2021 for the offences under Sections 406, 408 & 420 IPC. In confession Shalini admitted that she had misappropriated and cheated, an amount Rs.6,00,000/- which was transferred to the petitioner's account, and thereafter Shalini taken away the said amount, the petitioner account was used to route out the misappropriated amount for verification of the same. The petitioner was called for enquiry which cannot be termed as harassment. On the other hand, keeping this petition pending, due to which force could not be used now, the petitioner filed Crl.O.P.No.24197 of 2021 and obtained anticipatory bail before this Court on 14.12.2021.

The successfully avoiding and keeping herself away from the investigation, the learned counsel for the petitioner submitted that the petitioner was granted bail and as per the condition, she shall appear before the respondent Police, weekly once, cooperate with the investigation. At that time she shall give her explanation. He further submitted that there is no material, to connect, to show that petitioner received any money from her sister Shalini. The respondent Police is proceeding on its own surmises. Now the petitioner granted anticipatory bail and to appear before the respondent Police and to clarify the doubts of the respondent.

5. Accordingly, this Criminal Original Petition is dismissed.
