O R D E R

This Criminal Original Petition has been filed to modify the condition imposed by the learned IX Metropolitan Magistrate, Saidapet, Chennai, in Crl.M.P.No.383 of 2021 dated 01.11.2021.

2. The learned counsel for the petitioner submitted that the petitioner is not an accused and the lower Court, while granting bail to the petitioner, the trial Court imposed a condition to deposit a sum of Rs.1,00,000/- to the defacto complainant in hand at the time of production of sureties and the petitioner is ordered to be released on bail on his https://hcservices.ecourts.gov.in/hcservices/

executing a bond for a sum of Rs.10,000/- with two sureties to the likesum each, among which one must be his blood surety. However, he is unable to mobilize the funds to deposit the amount and his blood sureties.

Hence, the modification petition has been filed by the petitioner.

3. Heard the learned Additional Public Prosecutor appearing for the respondent police.

4. Considering the facts and circumstances of the case, reason is justifiable, hence, this Court modifies the condition that the petitioner is directed to deposit a sum of Rs.50,000/- instead of Rs.1,00,000/- to the defacto complainant and the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties with proper Aadhar card. The other conditions imposed by the Court shall remain intact.

5. With the above modification, this Criminal Original Petition is ordered.
