Respondent PRAYER : Arbitration Original Petition is filed under Section 11(6) of the Arbitration and Conciliation Act, 1996, praying to appoint and Arbitrator to adjudicate upon the disputes that have arisen between the petitioner and the respondent in respect of the Liquid Petroleum Gas (LPG) cylinders supplied under the Supply Agreement dated 25.03.2019 between the petitioner and the respondent.

ORDER

When the matter came up for hearing on 05.01.2023, learned counsel appearing for the both the parties requested to refer the matter to the Mediation and Conciliation Centre. Accordingly, the matter is referred to the Mediation and Conciliation Centre attached to this Court. 2.After the completion of mediation, the matter is listed today before this Court.

3.Learned counsel appearing for both the parties would submit that the parties have reached settlement, by entering into a Settlement Agreement dated 19.04.2023, signed by the parties along with their learned counsel and requested this Court to dispose of the Original Petition in terms thereof mentioned in the Settlement Agreement dated 19.04.2023 entered by the parties.

4.Considering the submissions made by the learned counsel appearing for both the parties and in view of the Settlement Agreement filed by them having arrived at an amicable settlement among themselves by the parties, this Court feels it appropriate to dispose of the Original Petition in terms of the 2/4

Settlement Agreement dated 19.04.2023, entered by the parties. 5.Accordingly, the Arbitration Original Petition is disposed of in terms of the Settlement Agreement dated 19.04.2023. The Settlement Agreement dated 19.04.2023 is recorded and the same shall form part and parcel of this order. Connected Application is closed.

6.Registry is directed to refund the eligible Court fee to the petitioner as per the Rules.
