Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, directing the 1st respondent herein to consider and dispose the Election Petition on merit filed by the petitioner on 04.10.2018 and represented on 27.02.2019, challenging the Election of 11 Members of the 2nd respondent Co-operative Society within a stipulated time in pursuance to the petitioner's representation dated 09.04.2019 and pass such orders.

Heard the Learned Counsel for the Petitioner and the Learned Counsel for the Respondents.

2. The Election Petition is filed by the petitioner https://hcservices.ecourts.gov.in/hcservices/

herein on 04.10.2018 was returned for not filing in time and want of requisite Court fees. Pursuant to that, the petitioner has approached this Court in W.P.No.3821 of 2019, seeking direction to accept the election petition. Accordingly, this Court has also directed the petitioner to represent the election petition along with Court fees. In spite of representing the appeal with Court fees, the 1st respondent has not taken the appeal on file. Hence, the Present Writ Petition is filed.

3. The Learned Counsel for the 1st respondent would submit that, the appeal papers were presented with delay, anyhow, the same will be taken for consideration and will be disposed in accordance with law as expeditiously as possible.

4. Recording the the same, the Writ Petition is disposed of, directing the 1st respondent to take appeal of the petitioner on file and disposed of in accordance with law, within a period of four months, from the date of receipt of a copy of this order. No costs.
