PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the first respondent herein in Na.Ka.No.7734/Ne4/2022 dated 14.09.2022 and quash the same and consequently direct the first respondent to allow the petitioner to continue the additional charge post of Jamedar till the regular incumbent is posted in that place. ORDER

Heard Mr.R.S.Anandan, learned counsel for the petitioner and Mr.P.Baladhandayutham, learned Special Government Pleader for the first respondent. There is no appearance on behalf of the second and third respondents.

2. The prayer in the present Writ Petition is for a direction to the first respondent to allow the petitioner to continue the additional charge in the post of Jamedar till the regular incumbent is posted in the place.

3. As per the order of the first respondent herein, the petitioner was given additional charge as Jamedar, since the said post was not filled up. Such an additional charge was made as a temporary measure. On 14.09.2022, the petitioner was relieved from the additional charge through the order of the first respondent, which is under challenge in the present Writ Petition.

4. The learned Special Government Pleader appearing for the first respondent placed reliance on the averments in the counter affidavit and submitted that the qualifications prescribed for the post of Jamedar are 2/4

that, the candidate should be an ex-service man, must be less than 45 years of age and should have passed S.S.L.C. Since the petitioner does not possess the required qualifications, he was relieved from the additional charge.

5. A perusal of the counter affidavit also reveals that the petitioner is aged about 55 years and possesses qualification of IXth Standard only. Since the petitioner does not possess the required qualification for the post of Jamedar, I do not find any infirmity in the action taken against the petitioner by relieving the additional charge.

6. Hence, there are no merits in the present Writ Petition. Accordingly, the Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 06.06.2023 Index:Yes/No Speaking/Non-speaking Order hvk 3/4
