This Civil Miscellaneous Petition has been filed seeking to condone the delay of 66 days in filing the above Civil Miscellaneous Appeal against the award dated 19.12.2024 passed in M.C.O.P.No. 273 of 2011, on the file of Motor Accident Claims Tribunal, Thiruvallur at Ponneri (In the court of IV Addl. District and Sessions Judge, Thiruvallur at Ponneri).
2. Mr.S.Vadivel, learned counsel for appellant submitted that after getting sanction from the competent authorities, the appeal papers forwarded by the Regional Office to the counsel on record and thereafter the appeal was filed on 20.06.2025, as a result of which, there is a delay of 63 days in filing the above Civil Miscellaneous Appeal arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Civil Miscellaneous Appeal.
3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition. Registry is directed to number the Civil Miscellaneous Appeal if it is otherwise found to be in order and take the appeal on file and list the matter before the National Lok Adalat to be held on 13.09.2025, since the matter was settled between parties. 08.08.2025 rpp https://www.mhc.tn.gov.in/judis
