2. Heard the submissions of Mr.A.R.L.Sundaresan, learned Senior Counsel appearing for the petitioner as well as Mr.S.Thiruvengadam, learned counsel appearing for the first respondent.

3. The learned Senior Counsel appearing for the petitioner would submit the interim direction of this Court dated 31.07.2019 in WP.No.22387 of 2019 and WMP.No.21720 of 2019 was not complied with yet, and that the proposed respondent herein had denied to provide the relief granted to the petitioner vide order of the Court dated 31.07.2019, and it is the stand of the official/the proposed respondent sought to be impleaded herein that he is not a party in the said writ petition.

4. In the light of the above facts and circumstances, this Court is of the considered view that the proposed fourth respondent viz., The Commissioner of Customs, Custom House, New Harbour Estate, Tuticorin-628 004, has to be impleaded as fourth respondent in the main writ petition. http://www.judis.nic.in 1/2

5. Accordingly, this petition is ordered, The Registry is directed to carry out necessary amendment in the cause-title of the main writ petition.

6. It is also brought to the notice of the Court that the petitioner herein has filed a petition to modify the order dated 31.07.2019 passed in WMP.No.21720 of 2019, before the Registry vide USSR No.113414 dated 30.08.2019 and the same is pending. The Registry is directed to number the petition, if the papers are otherwise in order and post it for hearing on 03.10.2019.
